Timeshare Consumer Association is pleased to announce another cutting-edge decision of the Supreme Court in elucidating and acknowledging the illegal practice operandi of Palm Oasis and many other resorts using much the same shameful tactics.

Puerto Calma in Gran Canaria, for example, sold to their consumer an impenetrable share, suggesting that the usual timeshare laws did not apply, therefore, leaving the unsuspecting consumers unprotected of any timeshare law protection.

This type of selling is to imply that the consumer owns part of this property. However, this is a strictly prohibited law. This sentence clearly excludes the concept that suggesting to timeshare owners that in fact they actually own a percentage of a property bypasses timeshare laws. Signifying that the consumer is an owner of the timeshare property is strictly prohibited.

There is no doubt that the justices of the highest ranking court in Spain agree that timeshare law does and will not apply. Therefore, all consumer contracts were affirmed as null and void that being on the bases that the term exceeded the 50 year maximum. For these reasons the consumers were each compensated more than 20,000 euros.

Having maintained their consistency and finding ‘in perpetuity’ the Supreme Court states contracts to be illegal and those consumers should be compensated.
