It just seems to be a roller coaster of court cases at the moment with all of the new rulings regarding floating weeks being deemed illegal.  The TCA have been following some of these cases that have been heard in the past month, and can bring it to your attention that there is definitely a pattern arising in respect of any timeshare contract purchased with floating weeks or points.

It has been deemed that ‘timeshare’ is a purchase of time, mainly of accommodation, but can be time of another physical thing such as a private jet, and if this purchase of time doesn’t specify the ‘time’ that you have purchased as in the purchase of floating or fixed weeks, then your contract may be illegal, and there may be a claim for compensation.

We can report on two cases in specific, both were heard in Gran Canaria, Spain, and both clients have been awarded compensation for the purchase of their floating weeks.  One of these cases was against Anfi Resorts, we have reported a lot on the recent bad fortune of Anfi, they seem to be knee deep in court cases at the moment between one thing and the next.  You can read more about what has been happening at Anfi here.  However, this could just be the tip of the iceberg when it comes to their floating weeks contracts sold.

Anfi Resorts SL have been taken for a sum of 25,460 euros, plus legal fees and interests.  The clients had found the floating weeks that they had, very difficult to use when they wanted to use them, often being told that there was no availability at that time.  The couple were delighted with the court ruling deeming that their contract was indeed null and void, and they recuperated double the amount initially paid as well as legal fees and compensation.

A very similar case was heard in Maspalomas, Gran Canaria earlier in the month, against Viajes Sonnentravel, a Gran Canaria based Lodging and Hotel sales agent.  Clients of theirs had purchased floating weeks some years ago, which they were also finding difficult to use.  These clients seeked legal help, and were rewarded with 15,000 euros of compensation with legal fees also being paid.
