Off the back of some incorrect publicity, Maui Corporation Counsel have written a statement to clear the air.  We thought we would share their news in case any of you are owners in the Ocean Resorts Villas and the Ocean Resorts Villas north, Maui.

The advert that some of you may have seen was in regards to the Retroactive Property Tax Assessments carried out since 2005.  These assessments have been made by the Real Property Assessment Division and are to be re-assessed by the county counsel of Maui.  The two timeshare associations have two pending lawsuits regard to the way the taxes have been assessed, and are looking to get back compensation of up to $30 million back for their property owners.  This is a private claim and is not relevant to any other timeshare properties in Maui, or for that matter any other residents.

Some residents of other timeshare resorts, as well as those that are owners in the above resorts, have seen announcements on Facebook or in other publications that differ to that stated above.  There has been an inundated amount of enquiries made to the Real Property Assessment Division, Maui County Council, the Mayor’s office and the Department of Corporation Counsel.  These officials are not in a position to give updates, and are not privy to this information.  Therefore, have requested that any enquiries that property owners may have are re-directed to the vacation owners’ associations or their lawyers.

The claim is with the courts in Maui at the moment, it was filed in November of 2015, and is still ongoing.  The taxes are thought to have been miscalculated, however there may be a long process in any refunds, if there are any.  Although it has been claimed that the monies will be paid back to the property owners if found that there has been a miscalculation, one has to wonder if this will happen.
