It was reported in the Atlanta, GA dated April 13th, 2017 that the Georgia Department of Law’s Consumer Protection Unit “CPU”, on behalf of the State of Georgia, has reached an agreement with Fractional Property Services “FPS” and the owners Matthew Delatorre and Joshua Wright.

Fractional Property Services offered to advertise and market consumers’ properties and to rent their timeshares.  Consumers stated that the FPS had informed them that they had interested parties waiting to rent their timeshare.   In order to contract this service consumers were requested in advance to pay an upfront fee. Consumers also stated that FPS failed to rent or sell their timeshare as discussed and refused to reimburse the upfront fees paid.

Therefore, on March 31st of this year, FPS, Delatorre and Wright entered into an Agreement Verdict and Injunction in which they have arranged to cease trading and to refund $118,429 in way of compensation to consumers who purchased their services and a whopping $305,000 in legal costs and fines.

Are you eligible for compensation?

If FPS did not deliver or achieve the services which they promised you between August 1st, 2014 and March 31st, 2017, you may be entitled to compensation under the Consent Order.  To be eligible for compensation:

  1. Your contract with FPS must have been entered between August 1st, 2014 and March 31st, 2017.
  2. The claim must be based upon a complaint that FPS did not provide or perform services as signified or assured by FPS; in addition
  3. You must have suffered a provable out-of-pocket (monetary) loss.

If you believe you have been miss-sold their services, you will need to contact the Georgia Department of Law in one of the following ways and to submit your claim and necessary documentation no later than December 31, 2018:

Please note, Consumers who fail to submit all of the mandatory information by December 31, 2018, will forfeit any claim to which they would be eligible under this settlement agreement.
